Closure Orders: Government confirms consultation later this year

What’s changed?
During the passage of the Crime and Policing Act, an amendment was proposed to increase the maximum duration of Closure Orders from six months to twelve months.
The proposal wasn’t progressed immediately because further consultation was considered necessary to understand the operational and legal implications.
The Government has now confirmed that consultation is expected later this year, with any legislative amendments anticipated before the end of 2026. We’ll continue to keep practitioners updated as developments emerge.

Why this matters
If implemented, longer Closure Orders could provide greater flexibility in cases involving persistent or complex ASB, or where there are associated challenges like gaining possession orders within the current 6 month maximum period. However, organisations will still need to demonstrate that the statutory tests are met and ensure Closure Orders remain proportionate to the circumstances.

Top Tip: A Housing Ombudsman reminder
One of this week’s key learning points comes from a recent Housing Ombudsman referral.
The decision reinforces an important principle for ASB practitioners:
A complainant being unhappy with the outcome does not necessarily mean the investigation was flawed.
Good ASB case management depends on:
- Following your organisation’s policy
- Maintaining clear and timely communication
- Demonstrating a person-centred approach throughout
- Explaining decisions and the evidence relied upon
These principles remain central to defensible decision-making and good customer experience.
