Legal Precedence and Procedural Clarity: Insights from Swindon BC v Abrook Court of Appeal Decision on ASBIs
The recent Court of Appeal case of Swindon BC v Abrook highlights the importance of adhering to statutory tests in granting Anti-Social Behaviour Injunctions (ASBIs). The judgment underscores the necessity for clear evidence demonstrating the actual or likely effect of behaviour on victims, rather than relying on general assertions.
Lady Justice Elisabeth Laing emphasised that distinctions like “aggressive” versus “passive” begging are not helpful and should not replace the statutory test. Moreover, the court must ensure that it is both just and convenient to grant the injunction to prevent anti-social behaviour. The case also reinforces the need for caution in granting powers of arrest and adherence to proper procedures, especially regarding without notice applications.
Janine’s thoughts: This decision tells us that when dealing with ASBIs, it’s crucial to provide clear evidence showing how someone’s actions affect others. We can’t just rely on general statements. The court also emphasised that decisions should be fair and reasonable, considering whether it’s really necessary to impose restrictions to prevent anti-social behaviour. Additionally, it highlighted the importance of following proper procedures, especially when applying for injunctions without giving prior notice.
